1) Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of services provided by VisRadar ("we", "us", or "our"), including form filling assistance, mock interview preparation, visa information consulting, document mailing support, and interview scheduling (collectively, the "Services"). By using our Services, you agree to these Terms.
2) Scope of Services (No Legal Advice)
- We are a travel and visa services agency. We are not a law firm and do not provide legal advice or legal representation, and no attorney-client relationship is created.
- We are not affiliated with any government, embassy, or consulate.
- We assist with procedural and logistical tasks only. Visa decisions are made solely by the relevant authorities.
3) Availability and No Guarantees
- Appointment availability is controlled by official systems. We cannot guarantee a specific date or time for any appointment or any visa outcome.
- Any time frames we discuss are estimates only.
4) Your Responsibilities
- You must provide complete, accurate, and truthful information and keep it up to date.
- You are responsible for meeting eligibility and documentation requirements set by the relevant authorities.
- If you share third-party data (for example, family members), you confirm you are authorized to do so.
5) Authorization and Account Access
- Some Services may require us to access and act within your officially registered account (for example, AIS) with your explicit consent and within the scope you approve.
- You may revoke access at any time, but doing so may affect our ability to deliver the Services.
- Credentials provided to us are stored with appropriate safeguards and may be deleted upon your request after the Service is complete (see Privacy Policy).
6) Anti-Fraud and Prohibited Conduct
- We will not falsify, alter, or misrepresent any information to improve the likelihood of visa approval or appointment scheduling.
- We do not participate in fraudulent, deceptive, or abusive activities, including identity misrepresentation, document forgery, or evasion of official rules.
- If we reasonably suspect fraud or misuse, we may suspend or terminate Services immediately and may report the matter to relevant authorities as permitted by law.
7) Fees, Payment, Refunds, and Cancellations
- Our fees and payment model (for example, pay-after-success, deposits, add-ons) will be disclosed before you confirm a Service.
- Unless otherwise stated in a written policy or order confirmation, fees are non-refundable after an appointment is confirmed. Pre-confirmation cancellations may be refundable subject to any disclosed processing costs.
- If you request changes (for example, rescheduling or changing consulates), additional fees may apply.
- Chargebacks or unauthorized payment reversals may result in suspension of Services and additional recovery costs.
8) Third-Party Systems and Force Majeure
- We are not responsible for outages, changes, delays, system safeguards, or policy updates of third-party platforms (for example, embassies, consulates, or official portals).
- We are not liable for delays or failures caused by events beyond our reasonable control (for example, government actions, strikes, internet failures, or natural disasters).
9) Privacy
Our Privacy Policy explains how we collect, use, store, and delete personal data. By using the Services, you consent to the practices described there.
10) Testimonials and Content You Provide
- If you share reviews, feedback, or testimonials, you grant us a non-exclusive, worldwide, royalty-free license to use and display them for marketing, subject to your withdrawal request at any time.
- You confirm you have the rights to any content you provide to us.
11) Intellectual Property
The sites, branding, texts, graphics, and materials we create remain our property or our licensors. You may not copy, modify, or distribute them without permission.
12) Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
13) Limitation of Liability
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Services shall not exceed the total fees you paid to us for the Services giving rise to the claim in the 12 months preceding the event. We are not liable for indirect, incidental, special, consequential, or punitive damages.
14) Indemnification
You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.
15) Termination
- You may stop using the Services at any time. Fees already incurred or due remain payable as per Section 7.
- We may suspend or terminate access for any breach, suspected fraud, or misuse.
16) Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
- Disputes shall be resolved by binding arbitration in Vancouver, BC, in English, under the rules of an established arbitral institution. Either party may seek injunctive relief in a court of competent jurisdiction.
- Class actions and jury trials are waived to the extent permitted by law.
17) Changes to the Services or Terms
We may update these Terms from time to time. The "Last updated" date will change accordingly. Your continued use after changes constitutes acceptance.
18) Miscellaneous
- Severability: If any provision is found unenforceable, the remainder remains in effect.
- Assignment: You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or reorganization.
- Entire Agreement: These Terms, together with our policies or order confirmations referenced herein, form the entire agreement.
